Privacy Notice

This Privacy Notice explains how personal data is processed when you visit adyton.gen.tr or contact us through the details published on it. It is provided under Article 10 of the Turkish Personal Data Protection Law No. 6698 (“KVKK”) and the Communiqué on the Procedures and Principles to Be Followed in Fulfilling the Obligation to Inform.

1. Data controller

The data controller is Balkan Şencan, Attorney at Law (Ankara Bar Association), practising as ADYTON Law Office.

2. What we process, why, and on what legal basis

a) Technical data when you visit the website. Your IP address, browser and device information, the date and time of your visit and the pages requested are recorded in server and security logs. We process this data to deliver the website, keep it secure and detect misuse. Legal basis: our legitimate interest (KVKK Art. 5(2)(f)) and, where applicable, compliance with our legal obligations (Art. 5(2)(ç)).

b) Cookies. Cookies that are strictly necessary for the website to work, including those that remember your cookie choices, are used without consent (Art. 5(2)(f)). Statistics cookies (Google Analytics) are used only if you consent through the cookie banner (Art. 5(1)). You can withdraw or change your consent at any time on the Cookie Policy page. The cookies we use are listed there.

c) When you contact us. If you write to us by email or call us, we process your name, contact details, the content of your message and any information you share about your matter. We do this to answer your enquiry, check for conflicts of interest, and assess and, if agreed, establish a lawyer–client relationship. Legal bases: steps taken to establish a contract (Art. 5(2)(c)), compliance with our legal and professional obligations as attorneys (Art. 5(2)(ç)), the establishment, exercise or protection of a right (Art. 5(2)(e)) and our legitimate interest (Art. 5(2)(f)). If your message contains special categories of personal data (for example, health or criminal-record data), we process it only where this is necessary for the establishment, exercise or protection of a right (Art. 6(3)(d)) or where another condition under Article 6 applies. Please do not send such data unless it is needed for your enquiry.

d) Embedded content. Some pages show content served directly by third parties: the map on the Contact page (Google Maps) and the videos on the Turkish Law Videos page (YouTube). When these pages load, your browser connects to Google’s servers, which receive your IP address and technical data and may set their own cookies. This processing is governed by Google’s Privacy Policy. The share links under our articles (X, Facebook, LinkedIn, email) send no data to these platforms unless you click them.

3. Method of collection

Personal data is collected by automated means through the website, server and cookies, and directly from you when you contact us by email or telephone.

4. Who we share data with

Within the purposes above, personal data may be shared with: our website hosting and IT service providers; Google (Google Analytics, only with your consent; Google Maps and YouTube when you open the pages concerned); courts, public authorities and other persons where we are legally required or authorised to do so; and, in connection with a legal matter, persons involved in that matter within the scope of our mandate. As attorneys we are bound by professional secrecy under the Attorneyship Law No. 1136.

5. Transfers abroad

Google’s services are operated from servers that may be located outside Türkiye, including in the European Union and the United States, where the level of personal data protection may differ from that in Türkiye. Statistics data is transferred to Google only on the basis of your explicit consent given through the cookie banner (KVKK Art. 9(6)(a)). You can withdraw your consent at any time on the Cookie Policy page.

6. Retention

We keep personal data only for as long as necessary for the purpose for which it was collected, or for the periods required by law and by the limitation periods applicable to possible claims. Statistics data is kept for the retention period configured in our Google Analytics account. Data is then deleted, destroyed or anonymised.

7. Your rights

Under Article 11 of the KVKK you have the right to: learn whether your personal data is processed; request information about the processing; learn the purpose of the processing and whether the data is used for that purpose; know the third parties in Türkiye or abroad to whom your data is transferred; request correction of incomplete or inaccurate data; request deletion or destruction of your data under Article 7; request that third parties to whom your data was transferred be notified of such correction, deletion or destruction; object to a result against you arising from analysis exclusively by automated systems; and claim compensation if you suffer damage because of unlawful processing.

8. How to exercise your rights

You can send your request in writing to the address above, by registered electronic mail (KEP), with a secure electronic or mobile signature, or by email from an email address you have previously notified to us, in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller. Your request should include your name and signature (for written requests), your Turkish ID number or, for foreign nationals, your nationality and passport or ID number, your address or email address for notifications, and the subject of your request. We will respond as soon as possible and within thirty days at the latest, free of charge unless the response involves an additional cost under the fee tariff set by the Personal Data Protection Board. If your request is rejected, our response is found insufficient or we do not respond in time, you may lodge a complaint with the Personal Data Protection Board under Article 14 of the KVKK.

9. Changes

We may update this Privacy Notice when our practices or the law change. The current version is always published on this page with its date.
